To be honest, considering his record, I'm surprised he's still employed - especially as this is in the USA!

No Surprise to me!

He is still employed because of the Union. Plain and simple.

Not so simple

I for one believe that this incident puts US ATC in a bad light. But to claim that a union has saved this persons job your probably right. (That's one of the unions job for dues and non dues paying members here in the US). The NTSB statement highlights failures on both the management and controller side of this issue. The system isn't perfect but management has the right to assign training/work and I hope they retrain this person thoroughly. But mainly I'm glad that no one was killed.
