The candidate 's medical has expired today, however his doctor can take his medical only within 14 days due to other commitments. Can I take his profcheck SEP(land) in the meantime providing he will not fly till his medical is valid again? Who is pilot in command during this profcheck?

Who is pilot in command during this profcheck? It can only be you! He cannot exercise the privileges of his licence without a valid medical certificate.

If it is an hour with an instructor for renewal by experience you are PIC but you should know that.

No way to fly the test. There was also concern, if the CPL/ATPL holder has an expired 1st class medical, but has still a valid Clas 2nd. We have been strictly told, that we cannot perform the check unles the applicant has again the 1st class, or "downgraded licene" to the LAPL/PPL.

Whoever told you is wrong. (Unless your country's authority is imposing stricter rules than are required.)

Those privileges are embedded in the licence.......

Also, what is the point in taking an SEP Rating Proficiency Check if someone
has 'downgraded' to LAPL?

No Class Ratings can be added to an LAPL

FCL.505 ATPL — Privileges
(a) The privileges of the holder of an ATPL are, within the appropriate aircraft category, to:
(1) exercise all the privileges of the holder of an LAPL, a PPL and a CPL;So as long as you have an appropriate medical, all privileges covered by the one licence.

Quite what is meant by 'all privileges of the holder of a LAPL' is unclear - does that mean that the ATPL holder needs to maintain an SEP Class rating, but restricted to 2000 kg aircraft and no more than 4 PoB? Or does he/she maintain 'rolling' validity as for the LAPL? If so, what happens when he/she regains a Class 1 or Class 2 medical and has an expired SEP Class rating, but has been flying hundreds of hours within LAPL restrictions? Will he/she now have to be assessed for 'refresher flying' requirements and fly a renewal proficiency check? That would be madness...

Another poorly thought out Part-FCL regulation...:rolleyes:
