I am doing the design for a calendar that a client wants to produce and sell.

One image she wants to use is am aerial photograph she herself took from a commercial balloon flight.

I am a bit concerned about the use of photographs from the air firstly regarding the licensing of a commercial balloon flight to allow photographs for commercial use and secondly about the rights to take (and publish) photographs of someone else's property.

Any comments about the legality of using photographs of the ground taken from a joy ride in a balloon, for commercial use?

The property owner has rights to images of their property. But very few know this or bother about it. But best to be careful if its National Trust property.

Okay unless it was taken in the UK from a balloon registered outside the EEA without the permission of the CAA. (Article 225 ANO 2009) :ugh:
