Do you think a town planner/building developer owes a "duty of care" to the occupants of an aircraft?


i.e a plane unknowingly flies into a building or man-made unmarked obstruction.

The point where your argumentation goes wrong is "unknowingly". There should not be such thing as "unknowingly" flying anywhere or into anything. If so, it's sure not the fault of the obstacle for being there or it's builders!
