I wasn't quite sure where to post this question, so mods please move to an appropriate forum if need be.
Now a colleague of mine has recently approached me for my opinion on a certain issue, I wasn't entirely sure on the answer so I was hoping that someone here may be able to shed some light on this.
The situation is my colleague holds a CAA CPL as opposed to a JAA CPL. The CAA ATPL exams on this license have lapsed and as a result to obtain his IR last year he had sat the JAA IR exams; hence now holds a CAA CPL with IR.
He is converting the CAA license to a JAR CPL licence, however as he only sat perf E in the national exams they are not allowing him to place a perf C aircraft type rating on the licence.
However, LASORS states (section A) that the requirements for the issue of a JAA CPL from a national CPL is the need to demonstrate a knowledge of flight planning and flight performance as required by JAR FCL 1.470. It goes on to further qualify the statement (note 6) that if you were credited the UK Flight Planning and Performance c, d, e or u you will have been deemed to have satisfied this requirement.
A JAA CPL holder will have performance C privileges. So does the above statement mean that once you convert a national CPL to a JAA CPL you should then have all privileges associated with a JAA CPL without restriction. Does this therefore not mean that in this case he should still be able to place a performance C aircraft on his licence once it is converted to a JAA licence without needing to sit the JAA performace exams.
