View Full Version : Admin Law Judge: DHL is citizen of USA

I thought this was going to go on forever, but yesterday a US Dept of Transportation administrative law judge found that DHL (well, now ASTAR Air Cargo) is a citizen of the US. In short, this issue was brought to the DOT by UPS and FedEx which claimed that DHL was foreign-owned and should be treated as such. Note that this is not the final word. There are a couple of other more minor questions yet to be resolved, and the decisionmaker on this is not the ALJ, but rather, someone farther up the food chain at DOT (thus, the ALJ has only recommended that DHL be found to be a citizen of the US). But, all-in-all, this begins to put it in the bag.

This case was/is an odd critter on a number of fronts, not the least of which was the fact that Congress told DOT to hear this case.
