A friend who use to instruct at the local FTO club has left to take up commercial flying in his spare time he,s been doing some instruction/BFR flying for some private owners. The examiner at the club says that what he,s doing is wrong.

There are a number of pitfalls for the unwary when doing what this instructor does;

1. His employer will no doubt wish to make maximum use of the 900 hours flying available from him in a year and all the other flight time limitations. Consequently, most employers require full disclosure of all other flying activity. By doing part time instruction, they may be in breach of their employment contract and/or the legal flight time limitations requirement.

Instructors are also subject to Flight time and rest limitations.

2. Certain training is required to be completed by an RTF or FTO. If he is not an RTF or FTO then the training provided will count for nothing.

3. Being paid for instruction in certain cases can be illegal (even with a CPL) and can have certain insurance implications especially when the aircraft has a Private Category C of A.

So basically......it all depends on the exact circumstances that exist for each flight.

Personally, I can't see a problem where an experienced instructor flies with some friends and happens to sign off the required instructional flight hour. If however, this guy advertises their services and fees then that is another matter.

Could it be that the FTO is objecting to competition?
