I would like to Know if JAR-145 allows to dispatch an aircraft, when a MEL repair interval has already expired.
Is it a common practice for operators to just send and operational acceptance until spare parts are available?
REGARDS
The MEL will specify the latest date by which the ADD is to be rectified and cleared. To keep deferring it is not an option.
Having said that, if the defect is cleared, and then reoccurs sometime in the future, the specified time to rectify will start again.
What type of defect do you have in mind?

A Rectification Interval extension can normally be approved via the Quality/Airworthiness department in exceptional circumstances. Does'nt happen too often, normally when spares cannot be procured within the alloted timeframe

Thank you for your answers. Could I assume that JAR-145 does not allow this practice?
It is for the incoming Captain "accepting" the aircraft to inspect the tech log, and ensure that the ADD has not time expired.
In date : consider accepting
Out of date : speak to engineering - do not sign accepting the ac.
