They can and have capped the profit share which is very different.
In certain jurisdictions like France and Spain the 13th month is payable to ground staff no matter what the operating profit or loss but Swire's keep that little gem quiet.
Ahh yeah its been capped in the past.....twice I recall....normally its enough for the local staff since it equates to their monthly salary, but not for pilots. If its capped it should be as a percentage but the local ground staff would be up in arms as well. No they screw over the pilots their most important staff.
