Approach climb gradient legality

Hi, here is a question about legality on approach climb gradient, taking an example of RWY07L HKG the required gradient for ILS CAT 1 approach is 7% , if the aircraft capability because of landing weight is only 6.25% it is understood that its not legal to fly the ILS CAT 1 , if the only runway available at time is 07L would that be legal to fly an ILS but use (higher) minimums that of a LOC ONLY (GS OUT) approach from the same chart as this is 5.7% only and aircraft is able to satisfy it.
Question 2 , In the same situation would that be legal to still use CAT 1 ILS minima knowingly that the aircraft can not satisfy published missed approach and in case of go around fly the operator's published Engine out procedure instead and inform ATC.
