I have a suggestion - lets split "regulatory enforcement' away from 'regulation writing". Police and lawyers enforce the law, public servants and politicians make the law. Over-simplified, I know, but two separate groups.
Only in aviation does a public service body write, oversee, and regulate the law. Let one bunch of wanna be lawyers (or, here's a thought, guys and gals with practical experience in commercial aviation NOT military has-beens or career public servants) write the regs. Then lets have another group to enforce the law, with any charges to be proven in a court of law - just like any other offender.
