There's not a simple answer to that, I'm afraid, @Katamarino. It is mostly an airspace requirement and airspace is still a national matter however much EASA may cry.
Netherlands certainly require mode S above 1200' and 8,33 at more and more aerodromes. (ELT required, too, btw). Most other countries less demanding but things are changing all the time.
