If there was no safety case, who signed off to say that the risks associated with th operation of the Mk10 ejection seat were Tolerable and ALARP? This must affect all aircraft fitted with the same type of seat.
And, as stated above, it follows there can be no valid Hawk safety case, and hence no valid Release to Service. As I said, it is inconceivable the HSE don't realise this will be raised in court. Perhaps the HSE don't think this is a gross breach (
