You are relying on their good will, if they couldn't place someone on the course you haven't taken up then they have lost the profit that they would have made and your £5000 will go some way to compensating them for that.
I would suggest that a non-refundable deposit is just that, and to throw money at a solicitor to try and retrieve it is just going to leave you further out of pocket.
