The captain's decision on where to go will have purely on medical grounds - he went to MAD as that was his best choice for treatment and to stop the issue escallating
what happens after that isn't (and shouldn't be) a consideration
Unforturnately you don' t get a "get out of Jail free" card for doing the right thing in this case
