It is an offence for a flight examiner to conduct a CPL, ATPL or MPL flight test if they are the person who 'recommended' the applicant for the flight test.

CASR 61.1295(2)

The operator should have provision in the Operations Manual for another instructor in the company to 'recommend' the applicant for the flight test if it is anticipated the Head of Operations will conduct the test. If they don't, you need a different examiner.
