Not sure what's going on here - I can assure you Tulane isn't cheap. It's the full Dental School, according to his attorney. Maybe he's getting GI benefits, somehow - although a conviction would probably nix those.
Then again, when your lawyer goes by "Birney" (Bernie?) anything goes.
