Although i'm sure you know what you are talking about, i cant find anything official on positive climb gradient being equal to level flight nor does the EU-ops speak of positive gradient
capability
It literally says :
The gradient of the net flight path
must be positive at at least 1 000 ft above all terrain and obstructions along the route
