Regardless, load security is the responsibility of the truck driver in virtually every transport situation. There have been instances where people have been killed because of loads falling off trucks, and in virtually all cases, it has been determined that the driver is responsible for checking and securing the load.
The only way a driver could find a way out of being responsible for a load falling off his rig, would be if the securing device failed because of a manufacturing flaw.
The laws and regulations regarding securing a load are generally extensive and all-encompassing - even to the extent of nominating how a load is to be restrained, and by how many securing devices, and the type and number of securing devices.
