Note that this is just a sample of agreement and its not complete.This is the general format given and approved duly by Civil Aviation Authority of Philippines and Philippine immigration .

This is just for the understanding for the party's and if any further clause are to be included the candidate is advised to inform me. The suggestions will be studied and discussed with the management for further changes. Irreverent or unnecessary suggestions may be disregarded. How ever the contents in the given sample will be included full in the original with changes if any .
D 228Type Rating – cum – Employment Program

This Agreement is made on the 9 th OCTOBER 2013 at Cebu , Philippines by ITI AI AVIATION and between:
ITI AERO ISLAND AVIATION . here in after referred as ITI AI which expression shall unless it be repugnant to the context or meaning thereof mean and include their legal representatives, heirs, executors and administrators on the FIRST part
name of student bearing Indian Passport No. ______________and residing at ______________________________________________ hereinafter referred as STUDENT which expression shall unless it be repugnant to the context or meaning thereof mean and include his/her legal representatives, heirs, executors and administrators on the SECOND part
Definitions:
CAAP: Civil Aviation Authority of Philippines
Program: Dornier 228 Type Rating-cum-Employment Program being offered by the FIRST party
OBS: Observation (second officer -flying) based training which shall be conducted in the cockpit of D 228

SBT: Simulator Based Training for D 228
PHP: The national currency of Philippines is Philippine Peso. One USD is approximately equal to PHP 43
Now, therefore, it is agreed as follows
The FIRST party is in the business of aviation operations such as charted flights and scheduled flight operations is willing to give employment to candidates who are ready to pay for type rating and training herby referred as SECOND party. Both the parties hereby agree to the following terms and conditions of the Program and mutually subscribe to the covenants of this agreement.
Program
Dornier 228 Type Rating for qualified students who have valid CPL license either issued/endorsed by CAAP OR ICAO accepted country's
In case of Students who do not have Philippine CPL, the existing valid CPL (of another country) needs to be converted to Philippine CPL which the fist party will be taking care of.

The contents of the course are designed as per the stringent requirements of CAAP upon successful completion of which the Student is eligible for employment in Philippines based charted flights or airlines.
This Type rating program ground training is provided in Philippines which is of approximately two weeks duration
Upon successful completion of ground training the student will be send for type rating . Once done with type rating , the Student is promoted to OBS (Student will be flying as fist officer which may be rephrased as second officer )Training which is of approximately 3 months duration.
The Committee of D 228 Captains and the members of the Management Committee shall assess the Student of OBS Training
Upon successful completion of OBS
the Student shall be awarded Type Rating on his CPL followed by employment as First Officer (Limited) in ITI AI by FIRST party
Upon employment as the First Officer in ITI AI ,it is guaranteed a minimum of 70 hours of flying per month while he is paid US droller 1600 per hour. In case the First Officer (Limited) flies more than minimum 60 to 80 hours he/she shall receive according to the per hour rate for the total hours flown during the month.
Once the candidate reach 1500 hours or more he/she will be assisted for ATP license and will be promoted as Pilot in command if eligible after observation by committee .
The Employment is for a period of 3 .5 years in the first instance which can be renewed . Deserving shall not have any difficulty in getting their contract extended beyond the initial period.
The FIRST Party shall also undertake the costs to process Student Medicals, Immigration formalities , Air fare for simulator training and re currency , Visa assistance, Police Clearances in Philippines and other necessary statutory clearances to work in Philippines.
Program Fee
The total package amount is USD 14,000
payment is to be made before commencement of the Program.

Fee for CAAP theory examinations and medicals are included in the Program fee
The Student is eligible to receive Stipend allowance 600 dollars(approximately PHP 30,000) during the OBS period. Regular fist officer salary will be given once the candidate is endorsed with type on cpl and done with work visa.
The First party incurs additional costs and fees associated with its Federal Government approval to train overseas students and administration in the delivery of training to overseas students consequently, included in the Total package cost. Overseas students are hereby notified that the Program fee for overseas students are approximately 25% higher than for Philippine native citizens
Program Hours
The Student acknowledges that the Program fee quoted and the flying hours therein are based on the ITI AI syllabus of training which slightly exceeds the minimum requirements of the CAAP for the issuance of various licenses/ratings. Any further flying training required by the Student to achieve the required standard will be charged at the ITI AI current rate at the time of flight/training are undertaken. If additional hours are required to get the Student to the required testing standard, the cost of the extra hours and such other relevant costs will be at the Students expense. Also the cost of repeating any exams failed will be at the Student’s expense. If the Student fails to complete the syllabus within 8 months period due to unsatisfactory attendance or performance, an additional course fee may be charged. However, the FIRST party shall grant additional time should the absence of attendance is backed by a genuine cause of leave from the place of
training.
Discipline
The Student undertakes to abide by the Overseas Student Code of Conduct of the FIRST party. In the Interests of further enhancing Aviation Safety, the Student further agrees to cooperate with the FIRST party in Drug and Alcohol Management Plan and is willing to undergo random Drug and Alcohol testing as required by the CAAP standards from time to time.
Attendance
According the Philippine Overseas Student Visa regulations, students must maintain at least 80% attendance in order to continue studying or training in Philippines. After counseling and cautioning, students who continue to have unsatisfactory attendance will be excluded from the class and must be reported to the Philippine Bureau of Immigration.
Accommodation & Food
Food and Twin sharing accommodation is provided by the FIRST party during the course and which will be extended during employment period too.
At the commencement of OBS Training and subsequent SBT the student has to incur the costs of his/her food as he/she would be entitled to get stipend during this period.

Provision of Information
The Student agrees that he has been given the following information before making the payment and is subscribing to the same
A general description of the content of the Program
The qualification or accreditation gained on completion of the Program
The teaching methods used (including any field trip or work experience requirements)
The assessment methods used
If the training is provided at other location than at the place of FRIST party, that it has been disclosed and all the costs including travel, visa, lodging and boarding expenses are included in the program
The facilities (for example classrooms, furniture, fittings etc)
The equipment (for example audio-visual teaching aids etc)
The learning resources (for example reference texts and software, videos) available to students undertaking the course
Information that upon successful completion and upon obtention of Type Rating that they are provided with the employment with ITI AI by the FIRST party
Information about the minimum level of English language proficiency, educational qualifications and flying experience required for the student to be accepted for the course (unless this is clearly not relevant)
The total package cost ITI AI inclusions and exclusions of items payable by the Student to get enrollment into the Program upon successful completion of which he secures employment with ITI AI as First Officer
That the FIRST party has informed all the intending overseas students accurately of the requirements as in the earlier part of the agreement and that there is no reference or suggestion that they do not have to study or attend classes or pass examinations or seek exemption on requirements to successfully complete the Program

The students also acknowledge that they have been briefed prior to enrollment that no suggestions have been made to them that they come to Philippines on a student visa with a primary purpose other than full time study and employment thereof.
Conditions & Cancellation of Enrollment
A Student is considered enrolled for the Program only upon payment of Program fee as described in Art 2.b above
Students need written permission from the FIRST party to defer or suspend the Program temporarily for a brief period. In cases where permission is granted in exceptional circumstances, the FIRST party has to advise the Immigration Department accordingly
Government regulations do not allow overseas students to transfer to other institutions during the Program period
Overseas students are required to study full time and maintain at least 80% attendance
Overseas students are required to maintain satisfactory level of progress in the Program in which they are enrolled, Students whose progress is unsatisfactory will have their performance reviewed by the Chief Flight Instructor who will make a recommendation on whether the Student’s enrollment should be extended or cancelled in extreme cases. In cases where the Student enrollment is cancelled, the Immigration authorities are duly informed and there shall be refund of half of amount paid till such time.
Students who are desirous of residing in a private accommodation other than that is provided by the FIRST party, they are free to do so, but such address has to be duly notified to the FIRST party so that FIRST party informs the Immigration Authorities accordingly. No reduction of Program fee is permitted in such a case, while the Student undertakes the costs of such shift in accommodation
In case of any accompanying family members of the Student, they shall seek their own accommodation and comply visa formalities accordingly. They shall not cause any kind of disruption to the Student in pursuing the Program.
Overseas students must maintain adequate health cover for themselves and any members of their family during their stay in Philippines. However, insurance is provided by First party and primary first aid facilities are available at the premises of study.

The FIRST party accepts the responsibility for information given to overseas students that is provided in this agreement for the Program in consistent with the terms of this agreement
The FIRST party does not accept any liability for information provided by sources other than those outlined above
Termination
If the Student does not perform his courses with skill and competence reasonably anticipated by the FIRST party to be suitable for the employment thereafter even after all help is extended including the extended duration the FIRST party reserves the right to terminate this Agreement
Complaints
The FIRST party provides the access to Student an independent grievance redressal procedure which provides for prompt resolution of any grievances. Students will be provided with this procedure at orientation. Beyond this grievance procedure, all students have right to pursue further action through the Philippine legal system. This agreement does not remove the right from the Students to take further action under Philippine consumer protection laws or to pursue other legal remedies
Confidentiality
The Student shall not disclose to any third party any confidential information belonging to the FIRST party or any associated company which it may acquire. The Student agrees that all material contained in this agreement is confidential and shall not be revealed to any third party either in part or in whole for any reason without written instructions
Liability
The FIRST party shall not be liable in any manner whatsoever for any claim, loss, damage, cost or expense suffered or incurred by Students in connection with or arising from any operational failings or any act, omission or neglect on the part of FIRST part while executing the Program
Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of Philippines and in relation to any legal action or proceedings to enforce this agreement or arising out of or in connection with this agreement each of the parties irrevocably submits to the proceedings in such courts on the grounds of lack of jurisdiction or on the ground that Proceedings have been brought in an inconvenient forum. In the event that any term condition or provision of this agreement is held to be violation of any applicable law or regulation the same shall be deemed to be deleted from this agreement and shall be of no force and effect and this shall remain in full force and effect as if such term and condition or provision had not originally been contained in this agreement. Notwithstanding the above, in the event of any such deletion the parties shall negotiate in good faith in order to agree on the terms of a mutually acceptable and satisfactory
alternative provision or term condition in place of the one(s) so deleted. This agreement constitutes the entire agreement between the parties in relation to its subject matter and supersedes all prior agreements and understanding whether oral or written with respect to such subjects matter and no variation of this Agreement shall be effective unless reduced to in writing and signed by or on behalf of a duly authorized representative of each party to this agreement. Should there arise any differences between the parties to this agreement as to interpretation of its terms and conditions, set forth in the agreement such dispute shall be arbitrated by a panel of arbitrators selected as follows before any other proceedings: each party to the agreement shall appoint one arbitrator and parties shall mutually agree on one independent arbitrator who shall chair the panel. The findings of the majority of the arbitration panel shall be final and binding.
Commencement Date
The FIRST party will make it available for providing the Program as specified above and the date on which both parties subscribe their signatures to this Agreement
