Loss of separation or not?
Airspace:

GND-FL095: class G
FL095-UNL: class C

a)
ABC123: maintaining FL100, IFR
DEF456: maintaining FL95, IFR

b)
ABC123: maintaining FL100, IFR
DEF456: maintaining FL95, VFR

No horizontal separation in both cases.
