The CAA have the power to detain aircraft but they could only do so with a similar legal order
Not true. Either the CAA or an 'authorised person' has, in specified circumstances, the power to prevent an aircraft from flying and to detain that aircraft without any prior court order. All CAA inspectors, for example, carry a warrant conferring such powers. ANO Articles 232 and 233 refer.
