This fact was withheld from aircrew and MoD lied about it when asked by MoD Legal Services before the FAI. If you haven’t got clearance to rely on ANY Nav system, then my instinct tells me flight in IMC is out of the question. And that gets to the nub of MoD’s case.
I would be very grateful if you could put a little more meat on the bones of that statement. As you know, I was involved at precisely the time of preparations for the FAI, and I would very much welcome the concept of people spending time 'at Her Majesty's Pleasure' as a result of 'non disclosure'! I have the means to follow this up.
