BMI > 30, problem?

Folks,

I understand some people have gotten into trouble recently trying to renew their class II medicals if their BMI has exceeded 30. Just looked through the JAR Medical but both JAR–FCL 3.295 and JAR-FCL 3.175 are talking of a BMI limit of 35, before a cardiovascular risk review needs to be undertaken. That would be Class I and II respectively.

It appears that Switzerland in particular have changed this to BMI 30 even for a Class II?

Can anyone comment on this? I wonder how it is possible that people get their medicals denied if the legal base is quite clear on this? Has anyone had this experience and what can be done about it?

Has anyone got the respective reference to EASA FCL? I understand that it is not finalized yet, but what does EASA have in mind regarding BMI?
