If a pax starts smoking it the cabin of an aircraft when i,m in charge then they get ONE chance to put it out before i call the police.
If they smoke in the toilet then the police are called to arrest them without further discusison.
In my opinion smoking in the cabin is a nusance to other pax but smoking in the toilet is a danger to the aircraft and so the law should show no mercy to people who do it.
