Yes, the guy made an error of judgement, but as hinted at above, there may well have been several other 'errors' in the chain behind him which may not have been addressed. He will undoubtably have 'learnt' from this (indeed, one never stops 'learning') but have the 'others'? Was there a collective sigh of relief "Whew, we got away with it".
