The fact of the matter is that the appeal is to decide whether a U.K. court has jurisdiction in the matter on a foreign tailed aircraft. If that is decided in the affirmative, (which IMHO is extremely unlikely due to the reciprocity in other jurisdictions), then there will be the case afterwards to decide if the practice is discriminatory.
