The court case for CVT is only to determine if the decision made by the Government minister at the Public enquiry was legal or not. If they decide it was not legal then the minister would be asked to reconsider. This is not a rerun of the planning application.
If it was, the downturn in traffic would indicate even less reason to pass the plans.
