No problem in the flight being scheduled but it should not depart until that defect is rectified.
As soon as the MEL limit expires the aircraft no longer remains airworthy.

From JAR OPS

b) An Operator shall not operate an Aeroplane
other than in accordance with the MMEL unless
permitted by the Authority. Any such permission
will in no circumstances permit operation outside
the constraints of the MMEL
