It is up to the pilot to declare the appropriate emergency state...ATC have guidelines to follow if the pilot is unable or unsure of what state to declare. I won't comment further about that particular occurance other then to say that a FULL EMERGENCY was entirely appropriate. It's my view that is is better to have too many rather than too few services available!!
