You assume that it is outside unless you have any information which suggests to the contrary.
No mode C = outside
Mode C indicating below/above CAS = outside
Mode C indicating inside = avoid and assume in
Other info suggesting inside (e.g. lost ac on freq. / other pilot report) = avoid and assume inside
