CASA is actually 1:36 not 1:40.
Virgin applied and were successful to specific gain approval to operate 737-800's with 4 cabin crew instead of 5, they did not receive a waiver on the 1:36 rule (so therefore can't operate a 737-700 with 3 crew as this would allow).
Never let the facts harm a good story though!
