Basically, under our law, anyone can sue anyone else in a criminal matter. The only proviso is that the State gets first bite of the cherry.
The thinking goes that, since you can't try someone twice, the state needs to be able to proceed with an effectual case. If private people brought a badly researched case to court people might get off and the state wouldn't be able to do squat.
But if the state doesn't want to proceed anyone with a reasonable case can do so.
If this was Trevor's trump card (getting to the Director of prosequtions) then this one may well backfire. And exactly the same regulations regarding bail etc. apply. Interesting times. I see 'CAA Chief' hasn't appeared here since his bail was returned. The new 'quieter' Trevor no doubt.
