Prof Checks and Sim Recurrency- Legalities

Hey all this is more posed to the SA Charter - Contract dogs but help from knowledgeable Airline boys would be appreciated, Was just wondering with regards to the law about having a current prof check on a Part 121 operations aircraft and sim recurrency. Some operators are being very slack on keeping their pilots current.

Seems the CAA has being inspecting here and there on the apron of late. AIC 18.20 dated 23-12-2005, says you have to do a prof check every six months for an aircraft above 5700kgs, and you need to go on a simulator once a year (but can exempt for an extra year)
But no-where on your licence does it state when your last prof check was, and it seems a costly affair for charter/contract companies to do these checks on two aircraft (example B1900 and ATR42). The law does state it’s the operators duty to ensure you get a Prof Check (just like your EPT/CRM/DG), while your licence is your responsibility. So one sim ride must be good enough for both types, surely though you must do two different Prof Check flights?

My main question is if your Prof Check is overdue or you have not been to a simulator in more than two years, and your company says you are ok to fly-ie: company clears you-And you are caught flying Part 121 ops by the CAA flying, Is it your ass or the "cost saving" company????
