What is interesting about the Japanese version states that any incedent after the directives have been handed over will count as strike three and the suspension could start from there.
Right now for JAL, they have to stop the free fall of consumer confidence. The key phrase has been "anything but JAL" and JAL is giving away tickets at bucket shop prices and offering double miles on just about any class of service to get pax in seats.
The suspension could be as short as one week or even one hour (true Japanese style--form over substance) but the psycholgical effect of the move on the Japanese flying public will mean another record year for companies competing on JAL's routes.
