NVFR recency requirements

NVFR recency ?

The CAO's specify the recent experience required to conduct NVFR as PIC in an aeroplane. This includes:
* 1 hour flight as PIC, ICUS or dual (within 1 year before proposed flight)
* 1 T/O and 1 landing PIC, ICUS or dual or
aeroplane flight review conducted part at night or
passed a flight test at night
(within last 6 months before proposed flight)

Disregarding the 3 T/O and land requirement for pax carrying, how does a pilot fly an aircraft under NVFR without pax when he/she has not conducted a NVFR flight within one year. Is a check flight with an instructor required, or do the above requirements (1 year and 6 months) only apply to pax carrying flights (PVT).

Taking into consideration that the NVFR is perpetual, in theory it can never expire ???
