Sorry to say my friend but I doubt the CAA will budge on this one as any fuel planned to be burnt prior to brakes release is NEVER included in TOM calculations.
It is certainly considered for Max Ramp wt. This is certainly covered in the Bristol course and I would be very surprised if any other school dosent explain this. Good luck though and all the best for the resit.
