The unique nature of the disposable load is not considered in the regulations. Under FAR121 you are not allowed to get credit for the almost instant and huge reduction in MTOW when you push the emergency dump button. Might be worth suggesting the company ( Neptune I am guessing) hire a DER and crunch the numbers which could then be validated with some test flights..
