This thread has mainly been a display of the best of Australian aviation with an unbelievable deal of resolve from my colleagues, coupled with a tremendous level of support from the wider community. Hopefully we致e moved past the stage where Qantas tries to pester us into anything (unless they池e planning on getting a ouija board out and running the deal past us again)- because this has taken a toll: financial pain, a heavily strained marriage and stress related illness are things that have affected me personally and I知 sure I知 not alone- so I知 bowing out of any discussion of the now defunct proposed deals and moving on to how best to direct our reps in their dealings with the FWC.

It may sound naive, because this process is steeped in politics, but about the only weapon we have might be a good argument and it痴 best to talk in terms the commission understands. I知 sure most people are aware, but the criteria for making a determination are:
  • the merits of the case
  • the interests of the employers and employees who will be covered by the determination
  • the significance of any arrangements or benefits in an enterprise agreement that applies to the employees and employers immediately before the determination is made
  • the public interest
  • how productivity in the relevant enterprise(s) might be improved
  • the reasonableness of the conduct of the bargaining representatives during bargaining
  • the extent that bargaining representatives have complied with good faith bargaining requirements, and
  • incentives to continue bargaining at a later time.

I知 not trying to direct debate but there is a fair amount of wisdom here so if anyone has anything insightful to say on these points I知 sure our reps would appreciate it.
