As a retired ATPL theory instructor I can tell you most students get through EASA ATPLs eventually, some take longer than others & 38 is not too late.
What you don't mention is how many more subjects & exam sittings you have remaining, this is somewhat critical as to a future plan.
I see you have failed M & B & FP both these are number crunching subjects, what's your maths like & have you passed GN yet?
I should start off by talking to your current course provider (ATO) & discuss your problems with them, clearly you are going to need some extra help be that with your ATO or private.
