There is a concept spread quite widely in English contract law (ie not criminal law) that if a person wishes to claim rights to something, then they need to be seen to trying in good faith to defend those rights on a regular basis. No, not just 'put in the small print' but actively say 'No' to people when those rights are being breached. Doesn't apply to everything, but one can't allow 9 people to take liberties over your rights and then get upset when the 10th person claims those same liberties
