In my words, it seems unclear to this day, whether the MAX is sufficiently aerodynamically stable in pitch or not. Whether the MAX requires a full blown stall envelope protection including all the mandatory redundancy, or not, may decide the fate of her certification.
Yes, this jumped out in the Reuters coverage, even before I saw the actual report. It's possible to imagine the FAA sliding past this question, under other circumstances, but with EASA, CAAC, etc. watching with suspicious eagle eyes?

Recommendation R3.4:

The FAA should review the natural (bare airframe) stalling characteristics of the B737 MAX to determine if unsafe characteristics exist. If unsafe characteristics exist, the design of the speed trim system (STS)/MCAS/elevator feel shift (EFS) should be reviewed for acceptability.
