It is an important question. The regulation is clear as you had found out already.
Where I came from, the conclusion was that on downwind we take the initiative and suggest/advise to ATC what had been pre-planned as the best course.: "Flight XXYY, in case of Missed Approach from short final runway 10L, request ------".
Not query about the options, rather directly ask for something straight (a bit of a play with words here). And wait for their helpful response, or instructions.
Does it stand up to scrutiny here?
