IMHO, the H103 DME/ARC criteria pertains to a procedure identified as a DME ARC approach, as in, “COPTER VOR/DME ARC 1”. TERPs defines such a procedure (TACAN, VOR/DME, and VOR, using an arcing final approach segment), however I don’t know if any exist. Furthermore, I don’t think the FAA expects, for example, a LOC approach with a DME/ARC from IAF to LOC interception to be flown to a HAT minimum of 500’. I am not aware of any IAP minima that is affected by how one gets to the FAF. Also note, the equivalent FAA fixed-wing OpSpec has no such thing as a DME/ARC procedure or minima.

I think this is a widely misunderstood and abused procedure. See FAA Order 8260 for further information. Again, the FAA General Counsel is your best source for clarification.
