Apparently his privacy and mental condition, are more important that the public's safety.

If his offence is punishable by jail time, and he is not charged due to mental health, he should be immediately locked up in a mental health institution for at least as long as the offence would be punishable for in the normal criminal system, and then they can do an assessment to see if he has recovered sufficiently to no longer be a menace to society.
