It actually gets a little more complicated with Brexit:
The Parliament has rewritten Regulation 261/2004, however the Council will not consider it due to a dispute (UK-ES) about Gibraltar.
On 31 March 2019 the UK leaves the Council (and the Commission and Parliament). The following day(s) the Council adopts the rewritten Regulation the ES way and it automatically applies to the UK (implementation agreement requires this).
