Latest from the basing office is employment will only be offered on COS 08....
Since most of us based in Canada rejected COS 08 I guess they felt it necessary to force it on us, true to CX form.

Sounds like a rumor that should not be spread very far. I wonder what the Canadian government would think of Cathay unilaterally trying to change somebodies contract? There will be a new manager of the basing companies on a 2 year contract, I wonder what the new person will do? Exactly what they are told of course.

I think this would be a better thread for the HKAOA website.

You don't have to accept it, do you? You have a contract with Cathay Pacific Airways, and they cannot unilaterally change it. They can try, as they often do - but this is kind of like their proposal in the beginning of a negotiation. They want to put forward a new anchor to the negotiation; one that should not exist. I'm confident that the AOA will nip this in the bud. If I were you, I'd send them a note reminding them that you are not on COS 08, and explaining that wrong contract was sent to you. Simple as that.

Now that the company has shown their hand, I'm sure there will be a lawyer or two reviewing it. Standing by for advise from the AOA..

I'm sure the AOA will have something to say about it but once again they will do nothing and the employees will be left, yet again, with the bat you know where.

Yes this is how it is. You sign the new COS 08 or be fired. It is simple. Yes you have an option to return to Hong Kong but we all know everyone took a base to stay on a base, so your only option is to sign or be terminated.
Some think that the Canadian courts will protect them but that is not the case. A Hong Kong based company “Veta Canada” now employs you but it is a Hong Kong Company under Hong Kong Law.

When Canada becomes onshore you will be on COS 08 or you are terminated. This is how it is going to work; you will have the deadline of 11:59 on December 31, 2009 to sign COS 08 or be terminated while you still are employed by “Veta Canada” a Hong Kong Company. If you decide not to sign, you contract will be terminated under your current contract section 35.3 (with 3 months notice).

At 0000 January 1, 2010 you will be either on COS 08 or be terminated, so technically when you are under Canadian Law you are already on COS 08. No change of contract was demanded under Canadian Law.

If the AOA or the Canadian Pilots decide to take us to court under Canadian Law, we will have the jurisdiction changed to Hong Kong, just like the USA 49er’s case. Simple really.

As you see, under Hong Kong Law it will take 8 years or more to see the case and that is a long time if you are terminated. If you sign over to COS 08 while still Veta Canada employed, no change of contract under Canadian Law.

How many of you will want to test this fact and not sign? I can honestly say we will receive 100% switching to COS 08 with no one moving back to Hong Kong.

There will be fear of termination and for first officers, no upgrade. You will sign away all your bypass pay and it will take along time to upgrade, as we will hire direct entry captains.

For first officers, this will be a career first officer airline and you may get a command in your 50’s, as all captains will retire at 65. Don’t despair, you will have signed away your by-pass pay and that will save us millions, which will add to MY BONUS.

Some may think we will expand but this is not the case. All 744’s will be replaced by 777’s by 2013 with no addition to capacity, just those new shiny jets you will fly for peanuts. Yes we have monkeys but slightly smarter than your average jungle monkey.

We will save more as we transfer a majority of our freighter operations to our Air China venture and we will absorb the freighter pilots into our passenger operation. Yes we may, on the flight deck, have the second officer being the most senior pilot on the Aircrew Seniority List with the most junior career position, with no by-pass pay of course.

As we onshore in other countries, the DFO will make sure all are on COS 08 with no by-pass pay. This will add to our bonus and We Managers will be retiring at 55 enjoying our golden years while the monkeys are flying in the middle of the night for Peanuts.

The DFO is doing a remarkable job at reducing your contract, which is why he receives millions in bonuses. The pilot group is so fearful of him they will continue to operate with no questions asked.

The DFO over the last number of years rostered more efficient patterns i.e. scheduled patterns with 3 sectors, duty cycles within 5 minutes of the AFTL limits, middle of the night two sectors from the Middle East just to name a few. All pilots are so fearful that discretion has to be used and all pilots do use it out of fear.

He had done very well at bringing fear to the pilot group and the best action he ever decided to do was fire the 49ers. This has served us well.

Can anyone answer a question: If you are based in Canada, but live in the US, how will taxes be handled (withholding etc). Thanks.

Last DFO update indicates CX's intent to onshore OABL by 1Jul10. I wonder what CoS they will be offering down there.
How long did it take to onshore Canada???

I guess they'll try to force CoS08 down the throat of my australian colleagues. So much for giving the choice on that CoS08/SLS shamble!

It just dawned on me that this idiot has really no idea what he/she is talking about.
All swire retirement ages were increased to 57 across the board mid last year. Right around the time on N.R's 50th birthday.
Words right out of his mouth.........

I think you need a cup of tea and a nice lie down, Mr leading edge device (sic). The Management is one of us! His posts use irony in an attempt to wake pilots up to the implications of working for a large corporation. He may stretch things a little and repeat himself occasionally but his posts expose the reality that in large airlines, pilots are just revenue-generating carbon-based units; not 'team members', 'valued employees' or 'highly qualified professionals'.

To quote a past CX CEO, management will push and push and push until they feel resistance. The Management is trying to wake us up to that fact.
