Anyone have info about why Germany decided not to be included under JAR and advantages and disadvantages therein.

German based airlines are working under JAR-OPS, but JAR-FCL is still not incorporated because the LBA (german FAA) and the government are very slow. The first switch-over date to jar-fcl was 1st july 1999, and since then we had a new date every six month. Currently the new date is in fall, around beginning of october.

As far as the explanation go....The German law requires publishing of any regulations to be in German language. To follow suit, the JAR wordings have been translated to what was the understanding of the translator. This (now German) text was given to lawyers who in turn worked on the German text to make it understable for any court. It is obvious that this text altered in this way cannot be used for aviation at all...
The process had to be redone...
And now the German government has to propose the law which may be introduced within 3 months after passing the parliament...
If, and that is almost for sure, the bill cannot put on any agenda before the summer break, there will be no JAR-FCL in Germany this year.
Talking to the LBA will only reveil that even their knowledge does not give any implementation date and that certain areas (medical etc...) are still not sorted to JAR conditions....:mad:
