Hi, I have a candidate wishing to do a JAA PPL skill test, who already has a valid FAA PPL with SEP rating. They have completed the required training and specified theory exams. I have done one hour of flying with the candidate, out of around 15 in total they completed with an instructor.

Under normal circumstances I know that I could not do the skill test, given that I have flown with the candidate. However in this case, they already have an ICAO compliant licence, so does this change things in any way, such that the 'can't test someone flown with' rule does not apply?

I should add the conversion training has all been completed at a UK FTO.

an ICAO Contracting State (not being a JAA Member
State), who has flown a minimum of 100 hours as
pilot of aeroplanes, is credited the JAR-FCL PPL(A)
flying training/experience requirements, except the
PPL(A) Skill Test. If no training is mandated, you would have no problem, but you state that you have conducted training for the licence which makes you subject to JAR-FCL 1.030(d) Examiners shall not test applicants to
whom flight instruction has been given by them
for that licence or rating except with the
expressed consent in writing of the Authority.
