That's what BA did on their E190's. Certified by Embraer for up to 114 (likes of flyNiki) pax but with BA only 98 seats onboard. 100 Seats would require mainline pilots.

Depending on how the scope clause is written it may not be as simple as removing some seats. With BACF and the Embraers the scope clause stated 'world fleet average seat number' . That is why BAcf don't have EMB 190's but EMB-190SR's which were a supplementary type certification and no-one else has got any. It may just be a paperwork exercise but just specifying 190's with less than 100 seats would not have been acceptable.

No, the scope clause didnt cause any problems however the legal ownership of the two hulls has proved to be a problem. Expext the contract to be complete late January.
